Official Regulations

NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING.  Odds of winning will depend on the number of eligible applications received.

ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. FAILURE TO COMPLETE THE APPLICATION AND PROVIDE TRUTHFUL AND PERTINENT INFORMATION MAY RESULT IN DISQUALIFICATION FROM THE COMPETITION.  DISQUALIFICATION IS IN THE SOLE DISCRETION OF KSTU FOX 13 and Community Television of Utah LLC.

 

KSTU FOX 13 will conduct the So You Think You Can Dance ticket Giveaway (“the Competition”) substantially as described in these Regulations.  Participation in the Competition constitutes each applicants’ and contestant’s full and unconditional agreement to, and acceptance of, these Regulations.  All decisions of KSTU FOX 13 are final and absolute and not subject to inquiry or appeal.  The Competition may be temporarily postponed or discontinued at any time without prior notice.

BACKGROUND INFORMATION:

By applying for participation in the Competition, each applicant and contestant understands that he or she may be subject to one or more background checks.  Background checks will include civil, criminal, financial, driver-history and any other type of background check deemed necessary by designated agents of KSTU FOX 13. Applicants and contestants may be required to provide additional information throughout the Competition if deemed necessary by KSTU FOX 13.

 

ELIGIBILITY REQUIREMENTS:

Only one (1) application per person/per day is allowed.  Applicants and contestants must be legal US residents 21 years of age or older and reside in the Salt Lake City Market as defined by the Nielsen Company.  To be eligible to participate, each applicant must complete an entire application package, including applicable release forms and waivers.  Only printed or typed applications will be accepted.  If a winner is disqualified, KSTU FOX 13 reserves the right in its sole discretion to determine an alternate winner or to not award that winner’s prize at all.  Employees of Community Television of Utah LLC, employees of KSTU FOX 13, the Contest's participating sponsor (The Maverick Center) and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. 

 

CONTEST PERIOD:

The Contest begins on July 30, 2010, at 8:00 a.m. local time and ends on August 14, 2010 at midnight local time. (“the Contest Period”).  KSTU FOX 13 reserves the right to extend the Contest Period.

 

HOW TO ENTER:

Beginning Monday, July 30 through August 14, 2010, Fox 13 will broadcast a :15 spot asking viewers to log on to fox13now.com, go to the contest page and correctly and completely fill out the entry form with their for their chance to win a set of tickets to So You Think You Can Dance.  On August 15, 2010, Fox 13 will randomly draw 5 winners from all correct entries received.

 

PRIZE:

Each of the 5 randomly drawn winners will receive a set of two tickets to So You Think You Can Dance, on November, 4, 2010, at the Maverick Center. 

 

Winner(s) will be notified by the phone number provided on their entry. Winner(s) will be required to complete, sign and return a Certification of Eligibility and Release within 10 days of the date of notification or they will be disqualified. If a prize is won by an eligible minor, then the winner's parent or guardian must also sign the minor’s Certification of Eligibil­i­ty and Release before the winner receives his or her prize.  If a winner cannot be reached, or if a winner does not return the Certification of Eligibility and Release within the designated time period, no prize will be awarded.   

 

Prizes cannot be redeemed for cash or substituted for any other items by the winner(s).  The winner(s) cannot assign or transfer prize.  Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.

 

The winner(s) is responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.

 

Only one prize will be awarded per household.  Individuals are eligible to win only one prize within any 1 year period, regardless of the number of giveaways entered. 

 

 

RELEASE; PUBLICITY; USE OF PERSONAL INFORMATION:

By participating in the Competition, each contestant and winner waives any and all claims of liability against Community Television of Utah LLC and its employees and agents, KSTU FOX 13 and its employees and agents, the Competition’s additional sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Competition.  In order to participate in the Competition, contestants must sign an official waiver form provided by KSTU FOX 13.  By participating in the Competition, the winner consents to KSTU FOX 13 and Community Television of Utah LLC’s use of his or her name, state of residence, and likeness for advertising and promotional purposes online, for broadcast, and in print, or in any other media worldwide in connection with the Competition, without limitation and without additional compensation, except where prohibited by law.

 

TELEPHONE, DELIVERY & COMPUTER DISCLAIMER:

KSTU FOX 13 disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond KSTU FOX 13 control, or otherwise. KSTU FOX 13 disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. No photocopies or mechanical reproductions of entry forms are permitted. KSTU FOX 13 is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.

Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other giveaway information by Sponsor or entrants for any reason whatsoever.  Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the giveaway or for entries that are late, misdirected or incomplete.  All entries become the property of Sponsor and will not be returned.  CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to cancel the giveaway if it becomes technically corrupted.

 

TAXES:

Any valuation of the prize(s) stated above is based on available information provided to KSTU FOX 13, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  All taxes, including federal, state and local taxes, are the sole responsibility of winner.  Each winner must provide KSTU FOX 13 with valid identification before any prize will be awarded. 

 

LIMITATION OF LIABILITY:

By participating, competitors agree: (a) to the Official Regulations and decisions of KSTU FOX 13, which shall be final in all respects; (b) to release, discharge, and hold harmless KSTU FOX 13, and its respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents from all liability, injuries, losses or damages of any kind to persons, including but not limited to death or property damage resulting in whole or in part, directly or indirectly, from participation in the Competition or any Competition-related activity; (c) that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize.  KSTU FOX 13, Community Television of Utah LLC, their sponsors, and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays.  KSTU FOX 13 shall have the sole discretion to administer the Competition and interpret and apply these Regulations.  Anyone using fraudulent means to participate in and/or win the Competition will be subject to disqualification. KSTU FOX 13, reserves the right to disqualify any contestant at any time, for any reason, including, without limitation, language, lyrics, activities or behavior deemed inappropriate. In consideration for entering the Competition, each contestant and winner grants KSTU FOX 13, Community Television of Utah LLC, its sponsors and its employees, agents, subsidiaries, advertising and promotion agencies the right to use the contestant’s name, voice, likeness and performance, and any portion thereof, without prior notice or compensation for any purpose and in any media now known or hereinafter devised. Such right shall be irrevocable, extend throughout the universe and inure in perpetuity. Without limiting the generality of the preceding sentence, KSTU FOX 13 and Community Television of Utah LLC shall own all rights, title and interest in and to all performances, recordings, videos and images rendered by contestants in connection with the Competition. Other than the prizes received by the Grand Prize winner, no contestant shall be entitled to receive any wages, benefits, fees or other compensation whatsoever as a result of participating in the Competition. In consideration for his or her participation in the Competition, each contestant agrees to release and indemnify KSTU FOX 13, Community Television of Utah LLC, and the officers, directors, agents, parent companies, subsidiaries and employees of KSTU FOX 13 and Community Television of Utah LLC, from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the contestant’s participation in the Competition.  Any expenses incurred by the applicant during the application process, including but not limited to, postage, shipping and materials preparation (videotape, photos, etc.) are the sole responsibility of each applicant and neither KSTU FOX 13 nor Community Television of Utah LLC will issue reimbursement for any expenses. All contestants and winners agree, by participation in the Competition, to submit to the personal jurisdiction of the courts of Utah.  All courts of Utah shall govern this Competition, without regard to Utah’s choice of law rules.  The courts of Utah shall be the exclusive forum for any dispute regarding any Regulation or activity associated with the Competition.

 

MISCELLANEOUS:

Each applicant and contestant agrees to abide by these Regulations.  Each winner must submit proof of eligibility and sign KSTU FOX 13’s release form to claim the prize. KSTU FOX 13 may substitute prizes, amend rules or discontinue the Contest at any time as announced on the Station(s).  KSTU FOX 13 disclaims any responsibility to notify the participants of any aspect related to the conduct of the Contest. 

 

OFFICIAL REGULATIONS:

To request an additional copy of the Regulations, send a self-addressed stamped envelope to the business offices of KSTU FOX 13 by August 15, 2010. Written copies of these Regulations are also available during normal business hours at the business offices of KSTU FOX 13 at 5020 West Amelia Earhart Drive, Salt Lake City, Utah 84116. Rules are also available online at the Contest Page of www.Fox13now.com. All applications become property of KSTU FOX 13 and will not be returned.

 

COMPLIANCE WITH LAW:

The conduct of the Competition is governed by the applicable laws of the United States of America, which take precedence over any regulation to the contrary herein.  The Competition is void where prohibited and subject to all federal, state, and local laws and regulations.
